These Terms & Conditions (“Terms”) govern bookings made with African Sky Safaris and Tours (Pty) Ltd (Reg. No. 2018/473230/07) (“African Sky,” “we,” “us,” or “our”). By requesting or confirming a booking, the client agrees to these Terms. Effective Date: November 21, 2025

1. Scope of Services

We offer privately guided tours led by guides employed by African Sky and arrange package travel services provided by third-party suppliers (including lodges, hotels, airlines, transfer operators, and activity providers). The specific services included in your itinerary are those expressly listed in the final quotation or booking confirmation.

2. Deposits & Payments

A non-refundable 20% deposit is required to secure a booking. The balance is due no later than 45 days before the start date. For bookings made within 45 days of travel, full payment is due upon confirmation. Payment must be made in the currency and to the account specified on your invoice.

3. Cancellations by You (Refund Schedule)

Refund percentages are calculated on the total package price, and include the non-refundable deposit. If the reservation is canceled, cancellation fees will be due and payable according to the following:

  • More than 45 days prior to arrival — 80% refund
  • 30 to 45 days prior to arrival — 70% refund
  • 15 to 30 days prior to arrival — 50% refund
  • Less than 15 days prior to arrival — No refund

4. Changes & Substitutions

Every effort is made to operate the itinerary as confirmed. However, unforeseen circumstances (e.g., weather, operational issues, overbooking, safety considerations) may require changes. We may substitute accommodations or services of equal or higher value. Route adjustments may be necessary; we will inform you as soon as reasonably possible.

5. Supplier Conditions

All travel arrangements made by African Sky are subject to the terms and conditions of the relevant suppliers. These may include their payment schedules, cancellation rules, liability limitations, and conduct/safety policies. By booking, you agree to be bound by applicable supplier conditions.

6. Travel Insurance

Comprehensive travel insurance is strongly recommended and is your responsibility. Your policy should cover, at a minimum: trip cancellation/curtailment, medical expenses and evacuation, personal liability, and loss/theft of baggage or documents. Claims must be pursued directly with your insurer.

7. Passports, Visas & Health

You are responsible for ensuring you have valid passports, visas, transit documents, vaccinations, and health certificates required for travel. Entry requirements vary by nationality and destination. We can provide general guidance, but official requirements should be confirmed with the relevant authorities before departure.

8. Liability & Assumption of Risk

Travel, outdoor, and wildlife activities involve inherent risks. To the maximum extent permitted by law, African Sky is not liable for loss, damage, injury, delay, or expense arising from acts or omissions of any supplier, force majeure events, or circumstances beyond our reasonable control. Nothing in these Terms limits liability for willful misconduct or gross negligence where such limitation is prohibited by law.

We recommend that you follow all safety instructions provided by suppliers and guides and obtain insurance appropriate to your activities.

9. Force Majeure

We are not liable for failure to perform, or delays in performance, caused by events beyond our reasonable control, including but not limited to natural disasters, severe weather, epidemics, acts of government, strikes, civil unrest, or technical transport issues. In such cases, we will assist with rebooking where possible; additional costs may apply.

10. Client Conduct

You must comply with local laws and supplier rules. Illegal or unsafe behavior may result in exclusion from the tour without refund and at your sole expense (including repatriation costs). We cannot intervene with authorities on behalf of any person violating local laws.

11. Complaints & Support

If you experience a problem during your trip, notify the supplier and African Sky immediately so we can assist. Claims must be submitted in writing with supporting evidence within 30 days of the incident.

12. Privacy

We process personal information in accordance with our Privacy Policy. By booking, you acknowledge that certain data will be shared with suppliers to fulfill your travel arrangements.
